Preamble

This is the Privacy Policy of LMLS Group Pty Ltd (ABN 41 601 100 485) (“LMLS”, “we”, “us” and when relating to us, “our”). We are committed to protecting the privacy of our customers (“you” and “your”) and complying with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) (“Act”). In this policy we describe how we manage your personal information.

1. The kinds of personal information we collect include:

1.1. contact details such as name, address, email address, mobile number, landline number and fax numbers

1.2. information relating to your circumstances and affairs relevant to the services we provide to you as instructed from time to time;

1.3. information regarding our communications with you; and

1.4. if you are a supplier or prospective supplier, information about your business skills, services, products and prices.

2. How we collect personal information

2.1. We collect personal information by various means including when;

2.1.1. you contact us with a question or inquiry;
2.1.2. you open an account with us in respect of the purchase of a product or the provision of our services
2.1.3. you subscribe to our newsletter or marketing and or promotional materials;
2.1.4. you visit our website; and
2.1.5. you request a quote in respect of the supply of a product or service.

2.2. Where practicable we collect personal information about you directly from you. However, we may have collected information about you from a third party such as a supplier or contractor.

2.3. If you do not provide us with accurate personal information we may not be able to supply you with our products or services.

3. The purposes for which we collect, hold, use and disclose
personal information

3.1. We collect, hold, use and personal information in order to:

3.1.1. respond to your enquiries;
3.1.2. provide our services;
3.1.3. monitor or improve the use of and satisfaction with our services; and 3.1.4. let you know about any developments, our expertise and services that may be of interest to you.

3.2. We disclose personal information:
3.2.1. in order to perform our services to our customers; and
3.2.2. subject to our confidentiality obligations, when using third party providers of services in support of our services to you.

4. The parties to whom your personal information is disclosed

4.1.Subject to our confidentiality obligations, we may share some relevant personal information with:

4.1.1. LMLS, affiliates, employees, contractors or our agents, undertaking the service we are providing to you specifically;
4.1.2. our e-mail marketing provider for the purposes of providing you our newsletter, invitations to events and updates in respect of our products or services; and
4.1.3. third party service providers who assist us with archival, auditing, accounting, legal, business consulting, website or technology services.

4.2. We also will disclose your information if required by law to do so or in circumstances permitted by the Act – for example, where we have reasonable grounds to suspect that unlawful activity, or misconduct of a serious nature, that relates to our functions or activities has been, is being, or may be engaged in, in response to a subpoena, discovery request or a court order

5. Disclosure of information outside the jurisdiction of collection

5.1. We do not disclose personal information to overseas recipients

6. Links to third party sites

6.1. LMLS’ website may contain links to websites operated by third parties. If you access a third party website via our website, personal information may be collected by that third party website.

6.2. We make no representations or warranties in relation to the privacy practices of any third party websites and we are not responsible for the privacy policies or the content of any third party provider or website.

6.3. Third party websites are responsible for informing you about their own privacy practices and we encourage you to read their privacy policies and obtain your own independent advice in respect of same.

7. Online Activity

7.1. Our website uses cookies. A cookie is a small file of letters and numbers the website puts on your device if you allow it. These cookies recognise when your device has visited our website before, so we can distinguish you from other users of the website. This improves your experience and the performance of our website itself to enhance our service delivery.

7.2. We do not use cookies to identify you. We warrant that cookies are only used to improve your experience on our website. If you do not wish to use the cookies, you can amend the settings on your internet browser so it will not automatically download cookies. However, if you remove or block cookies on your computer, please be aware that your browsing experience and our website’s functionality may be affected.

8. Opting out of marketing communications

8.1. We may, from time to time, send you newsletters, invitations and updates about our services.

8.2. These communications may be sent in various forms, including mail, SMS, fax and email, in accordance with applicable marketing laws, such as the Australian Spam Act 2003 (Cth). You consent to us sending you those direct marketing communications by any of those methods. If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.

8.3. You can opt out of receiving such communications from us at any time by notifying us using our contact details below or by clicking the “unsubscribe” option at the bottom of any marketing e-mail received from us.

9. Security

9.1. We take reasonable physical, technical and administrative safeguards to protect your personal information from misuse, interference, loss, and unauthorised access, modification and disclosure. For example, we maintain our files in secure offices and limit access to personal information to individuals on a need to know basis.

10. Access/correction/updating personal information

10.1. You can contact us to access, correct or update your personal information. Unless we are subject to confidentiality obligation or some other restriction on giving access to the information and we are permitted to refuse you access under the Act, we will endeavour to make your information available to you within 30 days. Examples of circumstances where we may refuse to give you access to your personal information include where;

10.1.1. giving access would be unlawful;
10.1.2. we reasonably believe that giving you access would pose a serious threat to the life, health or safety of any individual or to public health or public safety;
10.1.3. giving access would have an unreasonable impact on the privacy of others;
10.1.4. giving access could prejudice the taking of appropriate action in relation to unlawful activity as described in clause 4.2;
10.1.5. giving access could reveal evaluative information in a commercially sensitive decision-making process.

10.2. If you request to correct your personal information, we will correct, or, if we consider more appropriate, note your request for amendment of the information on your record.

10.3. We will not charge you to make a request to access your record but we may charge you to actually provide access depending on the costs associated with obtaining and providing the material.

10.4. These actions can usually be taken by contacting our customer relations representative using the contact information in clause 12 below.

11. Notification of Changes

11.1. If we decide to change our Privacy Policy, we will send you a copy of our revised policy or post a copy on our website.

12. Complaints / Contact us

12.1. If a breach of this Privacy Policy occurs, a complaint may be made to us by sending it to: Brook at [email protected] or by calling our offices directly.

12.2. We will endeavour to respond to any complaint within 30 days. If you are not satisfied with our response to your complaint you may seek a review by contacting the Office of the Australian Information Commissioner using the information available at http://www.oaic.gov.au/privacy/privacy-complaints.
